Family Trusts

The dti’s Code 100’s rules on trust are particularly onerous on Family Trusts. We have found that the majority of black people who wish to hold their BEE investments in family trusts, are doing so for estate planning purposes. The code’s provisions that prevent discretion of the Trustees on allocating benefits to the beneficiaries is a major problem. We have designed a codes compliant family trust that takes into account estate planning and the dynamic needs of an entrepreneur growing wealth through business opportunities.
